What Debts Can Be Discharged In Chapter 7 Bankruptcy?

Chapter 7 Bankruptcy is a proceeding under federal law that deals with asset liquidation. Filing for Chapter 7 will eliminate most of your unsecured debt, such as credit cards, medical bills, garnishments, judgments, unsecured loans, and repossession balances. These are called dischargeable debts.

There are some debts that a Chapter 7 Bankruptcy does not discharge, such as:

  • Certain tax debts
  • Student loan debts
  • Alimony and child support

If you have a secured debt, like a home mortgage or a vehicle loan, you will need to continue making payments in order to keep your property.

What Is Required to File For Chapter 7 Bankruptcy?

Meet the income requirement:  If your annual household income is at or below the median income in Minnesota for a household of your size, you are automatically eligible for a Chapter 7.  Even if your household income exceeds the median income, you are still allowed to file a Chapter 7 if you pass the “means test.”  We can advise you on the median income that applies to your case.  If your income is too high to file for Chapter 7 relief, we can help you seek relief under Chapter 13 Bankruptcy.

Completion of credit counseling: Credit counseling at an approved credit counseling agency must be completed within the 180-day period prior to filing. We will give you a list of places you can go to complete your required credit counseling.

Attendance at the hearing: Approximately 30 days after we file your case, you will need to attend a hearing called the Meeting of Creditors. We will represent you at that hearing. In most cases, your debts will be discharged approximately 60 days after the hearing. A discharge is a court order releasing you from your debts and ordering creditors not to attempt to collect them from you.
