1. How much does it cost?
The filing fee for a Chapter 7 case is $299 and the filing fee for a Chapter 13 case is $274. The attorney's fees will vary depending on the complexity of your case. We will give you a quote over the phone if you call our office.
2. How long does a bankruptcy stay on your credit record?
Chapter 7 and 13 stay on your credit report for up to 10 years.
3. How long does a bankruptcy case take?
An average Chapter 7 case can be completed within 4 months. A Chapter 13 runs 3-5 years, depending on your repayment plan. You won't be dealing with the bankruptcy filing for that long, but your repayment plan may take that long to complete.
4. Will I lose my possessions — my house, furniture or car?
Your house, the things inside your house, and your vehicle are usually protected. In general, you can also protect most of your personal property such as a motorcycle, guns, a snowmobile, etc. Remember, if your property has a loan against it, you will need to keep making the monthly payments in order to retain that property.
5. Can someone come into my house and take my things?
Our job is to protect your belongings. In most Chapter 7 cases, there is no pool of resources to distribute to creditors. If you have something that will not be protected when you file for bankruptcy, we will bring it to your attention.
