Alternative Dispute Resolution (ADR)
This is the common term for methods that are used to resolve disputes through negotiation rather than litigation. The goal is to help the disputing parties resolve their matter quickly and with as little contention as possible. Another ADR advantage is that it's significantly less expensive than litigation. Two common methods of ADR are arbitration and mediation.
Arbitration is similar to a trial in that a neutral third party presides over the matter, listens to both sides' grievances and has the authority to issue a decision binding on the parties. However, the environment is less contentious and the rules are less rigid than in a courtroom. Consequently, disputes in arbitration are resolved more efficiently and cost effectively than through litigation.
Mediation is an ADR technique in which a neutral third party actively helps and encourages the parties to reach an agreement that meets both parties' needs.
Our lawyer, James T. Hanvik, was a qualified neutral on the state's Supreme Court ADR list for eight years. In that role, he served as a mediator and as an arbitrator. He has significant experience in many different ADR settings, including both binding and non-binding arbitration.
